AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF POMEROY, IOWA BY AMENDING PROVISIONS PERTAINING TO TITLE VI PHYSICAL ENVIRONMENT CHAPTER 3 UTILITIES-REFUSE COLLECTION.

Be it enacted by the City Council of Pomeroy, Iowa:

Section 1. TITLE VI, CHAPTER 3, ARTICLE 5 “COLLECTIONS” OF THE CITY CODE OF POMEROY, IA is hereby amended to read as follows:

Section 6-3-5 COLLECTIONS AND CHARGES. All garbage and rubbish shall be taken from dwellings at least once each week and from public establishments as frequently as the City Council may require. The City shall collect the sum of nine dollars and twenty five cents per month from each household for the collection and disposal of garbage and refuse. The unit based pricing will allow a maximum of five – thirty gallon containers to be collected for the above fee of nine dollars and twenty five cents.

All cans and garbage bags for garbage and rubbish shall be kept as provided in the rules and regulations for collection of refuse.

Section 2. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

Section 3. Severability Clause. If any section, provision, or part of Ordinance shall be adjudged invalid of unconstitutional, such adjudication shall not affect the validity of the Ordinance as a whole or any section, provision, or part thereof not adjudged invalid or unconstitutional.

Section 4. Effective. This Ordinance shall be in effect from and after its final passage, approval, and publication as provided.
