REGULAR CITY COUNCIL MEETING
MINUTES
January 12, 2010
Council meeting called to order at 7:00 P.M. by Mayor Gene Becker
Roll Call: B. Meyer, C. Meyer, S Juilfs, R Bachman and D DeVore.
MAYOR AND COUNCIL COMMENTS: C Meyer asked about the Steve Johnson meeting, Mayor Becker stated that because of weather he had to reschedule it.
APPROVAL OF AGENDA: C Meyer made a motion, seconded by S Juilfs, to approve the agenda. Roll call: Ayes R. Bachman, C. Meyer, B Meyer and S Juilfs. Motion carried. D DeVore arrived at 7:03P.M. A complaint was received about a broken mail box. The resident stated that since they moved to town the mail box has been broken 6 times. C Meyer made a motion to replace the mail post and post this one time only. Motion defeated for lack of a second.

CONSENT AGENDA: R Bachman made a motion, seconded by D DeVore, to approve the consent agenda: Financials, Minutes, Requests, Reports, and Bill List. Roll call: Ayes R. Bachman, D DeVore, C. Meyer, B Meyer, S Juilfs, Motion carried.

COMMITTEE REPORTS: 
Library: The Library Board submitted their FY2011 budget to the Council. Carol Ford explained the need to increase the budget since they were $2,500 short in the salaries section for the 2010 budget and the only reason it wasn’t higher was due to not having a director for part of the year. The Council said they would keep that in mind when determining the new budget.
Water/Sewer/Streets: R Bachman informed the Council that the front differential needs to be replaced in the red truck and that the maintenance dept. found a used one for $400 at Delp Auto. The Council further discussed that the red truck needs to be used as the secondary plow for only up town and at intersections.
Fire Dept: Merissa Ewing presented the attendance record for the last 13 meetings and said that seven out of nine regular members attended the November election meeting. S Juilfs made a motion, seconded by C Meyer to accept the Fire Dept member’s election at the November meeting of Chief Dan Rosa, Asst. Chief Bruce Ewing, Captain Jeremy Norris, Lieutenant Doug Hepperle and Sec/Tres Merissa Ewing. Roll Call. Ayes: S Juilfs, D DeVore, C Meyer, B Meyer and R Bachman. Motion Carried. The Council told the Fire Dept. that a list of stolen items and prices need to be given to the Police Chief and City Hall.
Police: Chief Gerdes responded to 20 calls since the last Council meeting. Chief Gerdes stated that Sheriff Davis is asking every town in Calhoun Co. to donate $500 towards the purchase of an intoxilyzer for the County. C Meyer made a motion, seconded by D DeVore to donate $300 for the intoxilyzer due to the size of our community. Roll Call. Ayes: S Juilfs, D DeVore, C Meyer, B Meyer and R Bachman. Motion Carried.
Parks: Deb Casey presented information about the application for a grant for a new entrance sign at the north end of the Cemetery. The Council will review the application at the Budget workshop meeting set for January 27th at 6:30 in City Hall.
City Hall: The liquor license for the Pomeroy Area Market was tabled to the February regular meeting. Motion was made by D DeVore, seconded by B Meyer to approve the Mayor and Council appointments (noted below). Roll Call. Ayes: S Juilfs, D DeVore, C Meyer, B Meyer and R Bachman. Motion Carried.

Ordinance: #207 Amending Chapter 3 Utilities – Refuse Collection C Meyer read Ordinance #207. Section 1. TITLE VI, CHAPTER 3, ARTICLE 5 “COLLECTIONS” OF THE CITY CODE OF POMEROY, IA is hereby amended to read as follows:

  Section 6-3-5 COLLECTIONS AND CHARGES. All garbage and rubbish shall be taken from dwellings at least once each week and from public establishments as frequently as the City Council may require. The City shall collect the sum of nine dollars and twenty five cents per month from each household for the collection and disposal of garbage and refuse. The unit based pricing will allow a maximum of five – thirty gallon containers to be collected for the above fee of nine dollars and twenty five cents.
  All cans and garbage bags for garbage and rubbish shall be kept as provided in the rules and regulations for collection of refuse.
A motion was made by D DeVore, seconded by S Juilfs, to approve the second reading of Ordinance #207. Roll call: Ayes: D DeVore, B Meyer and S Juilfs. Nays: C. Meyer and R. Bachman. Second reading of Ordinance #207 passed on January 12, 2010.
