REGULAR CITY COUNCIL MEETING
MINUTES
November 10 , 2009
Council meeting called to order at 7:00 P.M. by Mayor Gene Becker
Roll Call: C. Loots, C. Meyer, S Juilfs, and R Bachman. Absent: D. DeVore
MAYOR AND COUNCIL COMMENTS: C. Loots stated that she completed the grant paperwork for the Shelter House and was going to have Deb Casey drop it off at the extension office in Rockwell City. C Loots also commented on her volunteer group’s recent progress reorganizing the cupboards in the Community Building. D DeVore arrived at 7:04P.M. D DeVore asked if anyone knew why the Fire Dept. had the trucks out with lights going on Saturday night Nov. 7th. Mayor Becker is going to follow up with Chief Rosa. S Juilfs gave an update on the City’s Hazard Mitigation meetings.
APPROVAL OF AGENDA: C Meyer made a motion, seconded by D DeVore to approve the Agenda. Roll call: Ayes R. Bachman, C. Meyer, C. Loots, D DeVore and S Juilfs. Motion carried.
CONSENT AGENDA: Council looked into the Water Fund and discussed that since the water tower maintenance contract payments for years one and two, of a five year contract, both happened in the Fiscal year 2009 budget a transfer of funds was needed. C Meyer made a motion, seconded by S Juilfs, to transfer $12,000.00 from Landfill enterprise to the Water enterprise fund. Roll Call: Ayes S Juilfs, R Bachman and C Meyer. Nays: C Loots and D DeVore. Motion Carried. C Meyer made a motion, seconded by D DeVore to approve final pay request #6 from R& R Excavating for $76,319.13 for the sewer lagoon project. Roll call: Ayes R. Bachman, C. Meyer, C. Loots, D DeVore and S Juilfs, Motion carried. D DeVore made a motion, seconded by C Loots to approve the Consent Agenda: Financials, Minutes, Requests, Reports, and Bill List. Roll call: Ayes R. Bachman, D DeVore, C. Meyer, C. Loots, S Juilfs, Motion carried.
COMMITTEE REPORTS: John Devitt was on hand to discuss the Sewer Lagoon project. He presented the 3rd and final change order from R & R Excavating. C Meyer made a motion, seconded by S Juilfs to approve the final change order for R & R Excavating of $4,933.42. Roll call: Ayes R. Bachman, D DeVore, C. Meyer, C. Loots, S Juilfs, Motion carried.
New Maintenance Shed: The Council asked that Kenny Rhea talk with Mayor Becker about the electrical installation and acquiring bids for it.
Streets: R Bachman and D DeVore are to research which streets in town need resurfacing and/or major repairs and report back to the Council at the December regular meeting.
Library: A motion was made by C Loots, seconded by D DeVore to approve Desiree Fitzgerald as the new Library Director. Roll call: Ayes R. Bachman, D DeVore, C. Meyer, C. Loots, S Juilfs, Motion carried.
Nuisance Abatement Hearing: Due to Steve Johnson being unable to attend the meeting a special hearing is set for Nov 16th at 7:00P.M. in the Library.
Police: Chief Gerdes gave the Council a report of calls for the month. The Council reviewed recent letters to nuisance properties and City Hall and Chief Gerdes are to follow up with letters regarding the City’s fines for offenders.
Garbage: C Loots read an email from Duane Schuttler about customers in Pomeroy “One resident has the lowest charge at $7.75. One resident has the next lowest charge at $8.50. Two residences have a $9.00 charge. Seventeen residences have a $9.50 charge. Fifty-five residences have a $9.75 charge and the rest of the residences have a $10.00 charge. There are 5 non-commercial residences with dumpsters. One he is sure of is used by the residents because it is used for animal waste. The others he is quite sure are shared by multiple residences. He is also sure that some city residents are dumping into commercial dumpsters. Duane also called the DNR regarding those citizens who carry garbage to the country to burn or dump there. They informed him that that is also illegal.” Mayor Becker asked to take a vote to see if the Council wanted to proceed with proposed City wide garbage pick-up. D DeVore made a motion, seconded by Loots, to formulate an ordinance for the collections of garbage by Gray Sanitation and set a collection fee. Roll call: Ayes: D DeVore, C. Loots and S Juilfs. Nays: R Bachman and C Meyer. Motion carried. City Hall is to write up a new ordinance for garbage collection with a monthly fee of $9.25 and present it at the next regular Council meeting for the first reading.
City Hall: A motion was made by C Meyer, seconded by R Bachman to approve the selling of cigarettes at the Pomeroy Area Market. Roll call: Ayes R. Bachman, D DeVore, C. Meyer, C. Loots, S Juilfs. Motion carried.
Shelter House Update: A motion was made by C Meyer, seconded by C Loots, to take $1,400.00 out in a loan for the Shelter House boiler instead of $1,100 as previously approved at the last regular council meeting. Roll Call. Ayes; R. Bachman, D DeVore, C. Meyer, C. Loots and S Juilfs. Motion carried. City Hall is to call in regards to the trailer/stage still parked at the park from the Men’s Club fundraiser.
